Please read these Terms and Conditions carefully before engaging our tombstone and grave marker cleaning services. By booking or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety.
1. Introduction
Welcome to Eternal Care Memorial. We specialize in the respectful cleaning and care of tombstones, headstones, grave markers, and monuments. Our mission is to honor the memory of your loved ones by providing professional, gentle, and dignified services. These Terms and Conditions govern the use of our services and constitute a legally binding agreement between you, the Client, and Eternal Care Memorial.
2. Definitions
The following definitions apply throughout this Agreement:

3. Description of Services
Eternal Care Memorial provides tombstone and grave marker cleaning services. Our services may include the removal of biological growth such as moss, lichen, algae, and mildew, as well as dirt, debris, and environmental buildup. We are committed to a "Do No Harm" policy, which means we use only biodegradable, non-destructive cleaning solutions and soft-bristle brushes or cloths. We do not use pressure washers, wire brushes, bleach, acids, or harsh chemicals that can cause damage to stone surfaces.
4. Service Limitations and Disclaimers
4.1 Pre-existing Damage and Deterioration
Many tombstones, headstones, and grave markers, due to their age and prolonged exposure to the elements, have pre-existing conditions such as cracks, flaking, chipping, erosion, instability, or natural wear and tear. Our cleaning process may reveal or highlight pre-existing damage that was previously obscured by dirt, biological growth, or debris. We are not responsible for such revelations.
You understand and agree that Eternal Care Memorial shall not be held liable for any damage that was present prior to our service, whether it was visible or not at the time of booking.
4.2 Fragile and Aged Materials
We will take the utmost care when cleaning all memorials. However, we are not liable for damage to materials that are inherently fragile, aged, or have deteriorated over time. This includes, but is not limited to, soft stone types, laminated markers, or memorials with compromised structural integrity.
4.3 No Guarantee of Results
While we strive for the best possible results, we cannot guarantee the complete removal of all stains, discoloration, or environmental buildup. The final appearance of the stone will depend on its material, age, condition, and the nature of the staining. Some deep-set biological growth may require multiple treatments over time to fully remove.
We cannot guarantee the restoration of faded, eroded, or missing lettering unless a specific lettering restoration service is booked separately.
4.4 Cleaning Effects
You acknowledge that some natural or unavoidable changes in appearance, color, or texture may result from the cleaning process. These changes are not considered damage and are a normal part of revealing the stone's natural surface.
5. Limitation of Liability
Eternal Care Memorial shall not be held liable for any damage, deterioration, or alteration to the gravesite, headstone, monument, or any associated items (including but not limited to vases, statues, plaques, and landscaping) that may occur during or as a result of our services. This includes, but is not limited to:

By engaging our services, you acknowledge that you are assuming any and all risks associated with the cleaning and care of the gravesite and its components.
6. Client Responsibilities
6.1 Permissions
It is your sole responsibility to obtain any necessary permissions from the cemetery, church, local authorities, or other relevant parties before we commence our work. Eternal Care Memorial is not responsible for any issues arising from a lack of proper authorization.
6.2 Disclosure of Information
You must provide accurate details of the headstone's location and condition. You are required to inform us of any known fragile areas, historical significance, previous damage, or specific sensitivities regarding the gravesite or monument prior to the commencement of services. Failure to disclose such information may limit our ability to exercise appropriate caution and may void any claims against us.
6.3 Access
You must ensure that we have access to the headstone on the scheduled date. If a cemetery requires a permit or advance notice for cleaning, you are responsible for arranging this before our visit.
7. Booking and Payment
Bookings can be made through our website, by phone, or by email. Payment must be made in full at the time of booking unless otherwise agreed in writing. We accept payment via credit card, debit card, or other methods as specified at the time of booking.
8. Cancellations and Refunds
Cancellations must be made at least 48 hours before the scheduled service. Refunds will only be issued for cancellations made before the cleaning process begins. A cancellation fee may be deducted from any refund to cover administrative expenses. We reserve the right to cancel services in cases of non-payment, unsafe conditions, or lack of access.
9. Photo Documentation
We may take photographs of the headstone's condition prior to our work and document the results of our cleaning. These photographs may be used for our internal records, quality assurance purposes, and, with your permission, for marketing and promotional materials.
10. Weather Conditions and Delays
Severe weather conditions may impact scheduled visits. In such cases, we will notify you as soon as possible to reschedule the service at the earliest opportunity. Our biological cleaning solutions work gradually, and full results may not be immediate. You may notice continued improvement in the weeks following our service as the cleaning agents continue to work.
11. Complaints and Dispute Resolution
Any complaints must be submitted in writing within seven (7) days of the service being completed. We will investigate and respond within five (5) working days. If an issue cannot be resolved through direct communication, we may offer a re-cleaning service or a partial refund at our sole discretion.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Eternal Care Memorial operates. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
13. Severability
If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
This Agreement constitutes the entire agreement between you and Eternal Care Memorial regarding the subject matter herein and supersedes all prior agreements, understandings, and representations, whether written or oral.
15. Acknowledgment and Acceptance
By booking our services, you confirm that you have read, understood, and agree to these Terms and Conditions. You acknowledge that tombstones and grave markers can be fragile, aged, or subject to pre-existing conditions, and you accept the inherent risks associated with cleaning such memorials. If you do not agree with any part of these Terms and Conditions, please do not proceed with booking our services.
